In compliance with the provisions of Law 34/2002 of July 11 on Information Society Services and Electronic Commerce (LSSICE), these terms regulate the use of the website https://incospel.com (hereinafter the “Website”), which INCOSPEL S.L. makes available to Internet users.

Access to the Website is free of charge, except for the cost of the connection via the telecommunications network provided by the access provider contracted by the users. Certain services are exclusive to our clients, and access to them is restricted. In general, the services provided by INCOSPEL S.L. are subject to the price (excluding VAT) indicated in the corresponding service proposal; under no circumstances are they offered or provided through the portal itself.

In instances and sections where our Website offers e-commerce services subject to a contract or payment, the General Terms and Conditions of Contract specified for such cases must be accepted.

Use of the Website confers the status of Website user (hereinafter, the “User”) and implies acceptance of all conditions included in this Legal Notice. The provision of the Website service is limited to the time during which the User is connected to the Website or to any of the services provided through it. Therefore, the User must carefully read this Legal Notice each time they intend to use the Website, as the Website and the conditions of use set forth herein are subject to change.

Certain services on the Website—whether accessible to Internet users or exclusive to INCOSPEL S.L. clients—may be subject to specific conditions, regulations, and instructions that, where applicable, replace, supplement, and/or modify this Legal Notice; the User must accept these terms before the provision of the corresponding services begins.

INCOSPEL S.L. accepts no liability for decisions made based on the information provided on the Website, nor for any harm or damages caused to the User or third parties resulting from actions taken solely on the basis of information obtained from the Website.

The information is subject to potential periodic changes without prior notice, arising from the expansion, improvement, correction, or updating of the Website’s content.

5.2.- Website Service Quality

Access to the Website does not entail an obligation on the part of INCOSPEL S.L. to ensure the absence of viruses, worms, or any other harmful computer elements. It is the User’s responsibility, in all cases, to have adequate tools available for the detection and removal of malicious software.

INCOSPEL S.L. shall not be held liable for any damage caused to the computer equipment of Users or third parties during the provision of the Website service, nor for any malfunction of the web browser or the use of outdated versions thereof.

5.3.- Service Availability

Access to the Website requires third-party services and supplies—including transmission via telecommunications networks—the reliability, quality, continuity, and operation of which are beyond the control of INCOSPEL S.L. Consequently, the services provided through the Website may be suspended or cancelled, or become inaccessible, either prior to or during the provision of the Website service.

INCOSPEL S.L. shall not be held liable for any damages or losses of any kind suffered by the User resulting from failures or disconnections in telecommunications networks that cause the suspension, cancellation, or interruption of the Website service, whether occurring prior to or during the provision thereof.

5.4.- Regarding Content and Servicies Linked Via the Portal

The Website access service includes technical linking mechanisms, directories, and even search tools that allow the User to access other Internet pages and portals (hereinafter, “Linked Sites”). In such cases, INCOSPEL S.L. acts as an intermediary service provider in accordance with Article 17 of Law 34/2002, of July 12, on Information Society Services and Electronic Commerce (LSSICE), and shall only be held liable for the content and services provided on the Linked Sites to the extent that it has actual knowledge of their unlawfulness and has failed to disable the link with due diligence.

Should the User consider that a Linked Site contains unlawful or inappropriate content, they may notify INCOSPEL S.L. in accordance with the procedure and effects set forth in Clause 7; however, such notification shall not, under any circumstances, entail an obligation to remove the corresponding link.

Under no circumstances should the existence of Linked Sites imply the existence of agreements with their operators or owners, nor should it be construed as a recommendation, promotion, or endorsement by INCOSPEL S.L. of the statements, content, or services provided therein.

INCOSPEL S.L. is not familiar with the content and services of the Linked Sites and, therefore, accepts no liability for damages arising from the illegality, quality, lack of updates, unavailability, errors, or uselessness of the content and/or services of the Linked Sites, nor for any other damage not directly attributable to INCOSPEL S.L.

In cases where personal data is collected, processed, or stored, this will be done in accordance with the Privacy Policy published on the website, which can be viewed in the website footer.

Furthermore, the notifying party must provide documentation proving the rights holder’s entitlement and, where applicable, the authority to act on behalf of the holder if said holder is a person other than the notifying party.

In order to improve the website’s features, INCOSPEL S.L. reserves the right to modify and update—at any time and without prior notice—the information contained on the website, its configuration and design, this legal notice, and any other specific conditions. Therefore, the User must read the Legal Notice each and every time they access the website.

INCOSPEL S.L. reserves the right to initiate such civil or criminal actions as it deems necessary regarding the improper use of the Website and Content, or the breach of the terms set forth in this Legal Notice.

All parties involved agree to submit to ordinary jurisdiction—specifically the competent Courts and Tribunals in accordance with the law—regarding any matters arising from the interpretation, application, and compliance with this Legal Notice, as well as any claims that may stem from its use.

Any dispute or conflict regarding the interpretation of the terms of this Legal Notice, as well as any matter related to the services of this website, shall be governed by the regulations currently in force in Spain.
